1. General
- You agree that you have read and understood these terms and conditions (‘Terms’) and that you accept that these Terms, together with any contract made by a confirmed booking, form the entire agreement between you and IML National trading as the Institute of Managers and Leaders Australia and New Zealand (‘IML’) with respect to your purchase of a Development Course.
- A ‘Development Course’ includes the following for the purpose of these Terms:
- IML’s New Manager course
- IML’s Intentional Leadership Essentials course
- IML’s Intentional Leadership Foundations course
- IML’s Intentional Leadership Accelerate course
- People Matters
- Virtual Workshops
- Webinars
- Short Course
- Development Day
- Member and other events
A Development Course may also be referred to by IML in these Terms, or on IML’s website, or in other marketing material, as a Development Program or a Program.
- IML reserves the right to amend these Terms at any time, without notice to you.
2. Payments
- Prices on IML’s website are in AUD and are inclusive of GST.
- Payment is due immediately via credit card at the time you book a place in a Development Course. Invoice payment may be available upon request (conditions apply).
- Bookings will not be confirmed by IML until payment by you is received in full.
3. Refunds, Transfers & Cancellation Policy
- Member and other events, Development Day, Webinars, Short Courses & Virtual Workshops (referred to in this clause as a “Short Course”)
- A minimum of 2 Business Days’ notice in writing is required for:
- A transfer of your booking to another session; or
- The nomination of a substitute attendee; or
- the request for the issue of a credit note, to be used towards a future Short Course. Any credit note issued MUST be redeemed within 12 months of the date of the original Short Course or it will expire, and
you must notify IML by email to programs@managersandleaders.com.au, quoting the name of the Short Course, the date of the Short Course and your name and contact details. Where prior notice is not provided by you to IML, then any failure by you to attend the Short Course will be treated as a cancellation, for which you will not be entitled to a refund.
- Where a Short Course is recorded, you cannot transfer to another session or nominate a substitute attendee. You will, instead, be provided with a recording of the Short Course within 5 Business Days of the conclusion of the Short Course.
- Cancellations will only be accepted in the first 48 hours after you book (‘Cooling Off Period”), provided that you book more than 48 hours prior to the date upon which the Short Course is to be provided. After the Cooling Off Period expires, all fees paid are non-refundable.
- A minimum of 2 Business Days’ notice in writing is required for:
- Intentional Leadership Development Courses (New Manager, Essentials, Foundations and Accelerate) and People Matters (referred to in this clause as “IL Development Course”)
- If you cannot attend an IL Development Course, then you must contact IML at least 30 days prior to the course commencement date and either:
- Nominate a substitute attendee for the IL Development Course; or
- Request that your enrolment in the IL Development Course be transferred to the same course at a future date, to be completed within 12 months of the date that the original IL Development Course was due to commence.
- Transfers to a course at a future date may only be accepted if your transfer to another IL Development Course does not cause the original IL Development Course to be cancelled due to insufficient numbers.
- Should you transfer your enrolment or nominate a substitute attendee as referred to in 4 (b) (i) above, then an administration fee of $250 is payable, which includes administration fees for attending to the transfer or substitution and to cover any pre-course activities and diagnostics.
- Where you provide more than 21 days of cancellation of your place in an IL Development Course, then IML will refund any fees paid by you less an administration fee of $250.
- Where you provide 21 days or less notice of cancellation of your place in an IL Development Course, then IML will refund to you 50% of the fee paid by you for your place in the IL Development Course and IML will retain the balance 50% to cover their costs incurred by your cancellation in the IL Development Course. You agree that the retention of 50% of the costs of the IL Development Course by IML is fair and reasonable.
- Cancellation of your place in an IL Development Course, or a request for a transfer or to substitute an attendee must be notified in writing to: programs@managersandleaders.com.au.
- If you cannot attend an IL Development Course, then you must contact IML at least 30 days prior to the course commencement date and either:
- Coaching Sessions
If you are unable to attend a coaching session on the allocated days, resulting in the coaching session needing to be rescheduled to another day not already allocated to coaching, a $350.00 fee is payable.
4. IML Cancellation or Postponement or Transfer from FTF to Virtual
- IML reserves the right at any time, at its sole discretion, and for any reason whatsoever, to:
- change the format, participants, content, facilitator, location and timing or any other aspect of the Development Course;
- postpone the Development Course or any part of the Development Course;
- cancel the Development Course or any part of the Development Course; or
- convert the Development Course from face to face sessions to virtual sessions.
- If the location and/or timing of a Development Course is changed or it is cancelled or postponed by IML you will be notified as soon as possible via email.
- If the Development Course is cancelled or postponed by IML, for reasons that are beyond IML’s reasonable control, IML may retain the price paid and will not be required to refund the fee paid by you for the Development Course.
- Where a People Matters course is cancelled due to there being less than 12 participants booked to attend within fourteen (14) days of the advertised delivery date, IML will provide you with written notification and will offer to provide a refund or reschedule the delivery for you provided you have booked and pre-paid to attend the course.
- For reasons other than as set out above or elsewhere in these Terms, IML will refund the fee paid by you for the Development Course less any reasonable administration costs (as determined by IML).
- IML is not liable for any loss, inconvenience, damage, additional expense, injury, delay, loss or profit, or any other claim as a consequence of the cancellation or postponement of a Development Course.
5. Presentation Materials, Speaker Opinions and Third Party Authors
- You agree that any presentation materials you may receive access to from speakers (before, during or post Development Course) will be used solely for your own internal, non-commercial purposes and you understand that unauthorised distribution is expressly forbidden.
- We are not liable for the information provided in the presentation materials or DISC or other diagnostic tools, in handouts or books that were written by third party authors.
- We do not accept any responsibility for speaker views and opinions, they are entirely the speaker’s own and in no way reflect IML’s views and opinions.
6. Development Programs and Continuing Professional Development
For all Development Courses we:
- will issue a Certificate of Attendance only upon express request; and
- are under no obligation to verify that the content of our Development Courses comply with your accreditation or continuing professional development scheme. We recommend that you gain approval of the session from your accreditation or professional body before attending the Development Course if you wish to claim points for continuing professional development.
7. Photography / Videography
- IML reserves the right to use any photography or videography taken at any Development Course held by IML, without the express written permission of those included in the photograph or video. IML may use the photograph or video in publications or other media material produced, used or contracted by IML, including, but not limited to: brochures, books, magazines, websites, and social media.
- A person attending a Development Course who does not wish to have their image recorded for distribution should make their wishes known to the photographer and/or contact IML at programs@managersandleaders.com.au in writing of his/her intention.
- By participating in a Development Course or by failing to notify IML in writing of your desire to not have your photograph used by IML, you are agreeing to release, defend, hold harmless and indemnify IML from any, and all, claims involving the use of your picture or likeness.
- Any person or organization, not affiliated with IML, may not use, copy, alter or modify IML photographs, graphics, videography or other, similar reproductions or recordings without the advance written permission of an authorized person from IML.
8. Limitation of Liability
- To the extent permitted by law, we exclude all conditions and warranties relating to your purchase or booking of a Development Course and attendance at a Development Course.
- Where our liability cannot be excluded, such as in relation to Consumer Guarantees under the Australian Consumer Law or other prescribed terms under legislation, our liability for breach is limited to the face value of the Development Course purchased by you, plus any relevant booking and delivery fees.
9. Law and Jurisdiction
These terms and conditions of sale, any contract made by a confirmed booking and all directly related matters shall be governed and interpreted exclusively under the law and courts of the State of Queensland. You submit to the exclusive jurisdiction of the Courts in Queensland, Australia and, specifically, in the District of Brisbane.
10. Privacy Policy
Any personal information submitted by you via IML’s Website will be handled in accordance with our Privacy Policy.
